These Terms govern your use of the OldMate mobile app, related online processing services, and askoldmate.com (together, the "Service"). The Service is operated from Australia by [EXACT LEGAL OPERATOR], at [PUBLIC BUSINESS ADDRESS]. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility and accounts
You must be legally able to agree to these Terms. The final minimum-age and parental-consent rule must be added before launch. You must provide accurate account information, protect your password and device, and promptly tell [email protected] if you suspect unauthorised access.
Your account protects access to OldMate's online transcription and enrichment services. It is not currently a cloud backup of your saved contacts, notes, or recordings.
2. Your content and other people's information
You keep ownership of content you provide. You give OldMate a limited licence to transmit, process, and format that content only as needed to provide, protect, and support the Service. This includes sending audio, transcripts, typed notes, names, and relevant existing context to Supabase and OpenAI as explained in the Privacy Policy.
You promise that:
- you have the rights, permissions, consents, or other lawful basis needed to record and process the content;
- your use complies with recording, privacy, confidentiality, employment, and intellectual-property laws that apply to you;
- you will not use OldMate for covert surveillance, harassment, discrimination, stalking, impersonation, or another unlawful purpose; and
- you will avoid submitting unnecessary passwords, payment-card details, health records, government identifiers, or similarly sensitive information.
Recording consent rules vary by country and state. OldMate's visible recording state does not itself obtain permission from another person.
3. AI-generated results
Transcripts and AI-generated names, summaries, tags, commitments, suggestions, and questions may be incomplete, inaccurate, or misleading. Check important information before relying on it. OldMate must not be used to make legal, medical, employment, credit, insurance, housing, or other high-impact decisions about a person.
4. On-device storage and data loss
The durable copy of your relationship memory is stored locally on your device. Unless a future feature expressly says otherwise, OldMate does not synchronise that content between devices or restore it from your OldMate account. Deleting the app, losing or damaging the device, clearing app data, changing backup settings, or a software fault may cause permanent loss. Maintain any backup you require and check what your Apple device backup includes.
5. Acceptable use
You must not:
- break the law or infringe another person's rights;
- circumvent security, authentication, rate limits, or service restrictions;
- probe, overload, scrape, reverse engineer, or disrupt the Service except where law does not allow that restriction;
- upload malicious code or content intended to manipulate or damage the Service; or
- resell or provide shared access to your account or OldMate's online processing.
6. Third-party services
OldMate depends on Apple, Supabase, OpenAI, Google, and internet or hosting providers. Their services and terms may affect availability and processing. We are responsible for choosing and configuring our processors, but we do not control the App Store, your network, device backups, or every interruption in a provider's service.
7. Ownership
OldMate and its software, branding, design, and original website content are owned by the operator or its licensors. These Terms do not transfer those rights to you. Third-party components remain subject to their own licences. No open-source licence is granted unless a repository contains an express licence file covering the relevant code.
8. Changes, suspension, and account deletion
We may update the Service, impose reasonable limits, suspend access to protect users or the Service, or discontinue features. If a change materially affects these Terms, we will give notice where reasonably required.
You can initiate full account deletion at Settings → Delete account. Deletion removes the remote authentication account and the current user's local OldMate data, subject to limited security/legal records and processor copies that expire under the Privacy Policy. Merely signing out does not delete an account or local relationship memory.
9. Service quality and liability
We aim to provide a reliable Service, but do not promise that it will always be available, error-free, or suitable for every purpose. To the extent permitted by law, the Service is provided without implied guarantees beyond those that cannot lawfully be excluded, and neither party is liable for indirect or consequential loss that was not reasonably foreseeable.
Nothing in these Terms excludes, restricts, or modifies a right or remedy that cannot be excluded under the Australian Consumer Law or another applicable law. Any final limitation of liability must be reviewed against the operator's business model and launch territories.
10. Apple terms
If you download OldMate through Apple's App Store, Apple's standard Licensed Application End User License Agreement applies unless OldMate publishes a valid custom EULA in App Store Connect. Apple is not responsible for providing support for OldMate. Any mandatory rights you have under Apple's terms or applicable law continue to apply.
11. Governing law and contact
