These Terms govern your use of the OldMate mobile app, related online processing services, and askoldmate.com (together, the "Service"). The Service is operated from Australia by Jonah Ease. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility and accounts
You must be legally able to agree to these Terms. You must be 18 or older to use OldMate. You must provide accurate account information, protect your password and device, and promptly tell privacy@askoldmate.com if you suspect unauthorised access.
Your account protects access to OldMate's online transcription and enrichment services. It also holds a backup of your relationship memory, which is always on while you are signed in. Clause 4 sets out what it does and does not promise.
2. Your content and other people's information
You keep ownership of content you provide. You give OldMate a limited licence to transmit, process, store, and format that content only as needed to provide, protect, and support the Service. This includes sending what the AI features need to our AI providers, and holding a backed-up copy in your account, as the Privacy Policy explains.
You promise that:
- you have the rights, permissions, consents, or other lawful basis needed to record and process the content;
- your use complies with recording, privacy, confidentiality, employment, and intellectual-property laws that apply to you;
- you will not use OldMate for covert surveillance, harassment, discrimination, stalking, impersonation, or another unlawful purpose; and
- you will avoid submitting unnecessary passwords, payment-card details, health records, government identifiers, or similarly sensitive information.
Recording consent rules vary by country and state. OldMate's visible recording state does not itself obtain permission from another person.
3. AI features and results
OldMate’s core features use AI. When you create your account, or the first time you use a version of OldMate that asks, you agree to the AI processing the Privacy Policy describes; the way to stop it is to delete your account.
Transcripts and AI-generated names, summaries, tags, commitments, suggestions, and questions may be incomplete, inaccurate, or misleading. Check important information before relying on it. OldMate must not be used to make legal, medical, employment, credit, insurance, housing, or other high-impact decisions about a person.
4. Storage, backup, and data loss
Your relationship memory is held in your OldMate account, and the app keeps a working copy on each device you sign in to. This clause is the express statement that earlier versions of these Terms reserved. While you are signed in, OldMate saves your people, notes, recordings and photos to your account, and restores them when you sign in on another phone or in your browser. Current versions of OldMate do not read your phone's address book; links that earlier iPhone versions made to it are kept with your account. Backup is always on while you have an account and cannot be turned off. Deleting your account deletes the copy OldMate is holding.
Backup is not instant replication. It catches up when you open or leave the app, and when you ask it to, so a change made shortly before a device is lost may never have reached your account. Restored recordings arrive as you tap them, and ahead of you only if you switch background fetching on, not all at once. We do not promise that a backup is complete, current, or recoverable at any particular moment.
Until a change reaches your account, your device may hold the only copy of it. Deleting the app, losing or damaging the device, clearing app data, or a software fault may then cause permanent loss of anything captured since the last catch-up reached your account.
OldMate's backup is not a general file backup, an export, or a way to share your memory with another person; it restores OldMate's own content into OldMate on a device you sign in to. Maintain any backup you require and check what your operating-system backup includes.
5. Acceptable use
You must not:
- break the law or infringe another person's rights;
- circumvent security, authentication, rate limits, or service restrictions;
- probe, overload, scrape, reverse engineer, or disrupt the Service except where law does not allow that restriction;
- upload malicious code or content intended to manipulate or damage the Service; or
- resell or provide shared access to your account or OldMate's online processing.
6. Third-party services
OldMate depends on Apple, Supabase, our AI providers, and internet or hosting providers. Their services and terms may affect availability and processing. We are responsible for choosing and configuring our processors, but we do not control the App Store or Google Play, your network, device backups, or every interruption in a provider's service.
7. Ownership
OldMate and its software, branding, design, and original website content are owned by the operator or its licensors. These Terms do not transfer those rights to you. Third-party components remain subject to their own licences. No open-source licence is granted unless a repository contains an express licence file covering the relevant code.
8. Changes, suspension, and account deletion
We may update the Service, impose reasonable limits, suspend access to protect users or the Service, or discontinue features. If a change materially affects these Terms, we will give notice where reasonably required.
You can initiate full account deletion at Settings → Delete account. Deletion removes the remote authentication account, everything backed up to it including recordings, and the current user's local OldMate data, subject to limited security/legal records and processor copies that expire under the Privacy Policy. You may also request account deletion without reinstalling the app through our account-deletion page. Email requests are handled manually after ownership verification; we provide expected timing when acknowledging the request and confirm when it is completed. Remote deletion cannot erase an offline device or a device backup you control. Merely signing out does not delete an account, a backed-up copy, or local relationship memory.
Subscriptions
OldMate is a subscription, paid monthly or yearly: A$6.99 a month or A$59.99 a year in Australia. You see the price before you pay, and there is no free trial. You pay through the App Store on iPhone, Google Play on Android, or, in your browser, a checkout run by Stripe and RevenueCat; purchases through Apple and Google are also governed by their terms. One subscription covers your account everywhere you use OldMate.
Renewal. A subscription renews automatically at the end of each month or year, and you are charged for the next one, until you cancel. If the price is going to change, you will be told before your subscription renews at the new price.
Cancelling. Cancel where you subscribed: on iPhone in your App Store settings, on Android in Google Play, and in your browser at Settings → Manage subscription, which opens the billing portal. Cancelling stops the next renewal, and you keep OldMate until the end of the time you have paid for. Deleting your account doesn’t cancel your subscription, so cancel it first.
Refunds. If you subscribe in your browser or on Android and OldMate isn’t for you, email privacy@askoldmate.com within a month of your first payment and we will refund it in full. On iPhone, Apple handles payments and refunds, so ask Apple at reportaproblem.apple.com. Nothing here limits your rights under the Australian Consumer Law.
Launch offer
Accounts created while the OldMate launch offer is open receive the current OldMate plan free forever, and don’t need a subscription. No payment card is required for it. The offer is open to new accounts until 11:59 pm AEST on 31 October 2026, and closes to them at that time. It belongs to the qualifying account and remains subject to these Terms, including acceptable use and service availability.
9. Service quality and liability
We aim to provide a reliable Service, but do not promise that it will always be available, error-free, or suitable for every purpose. To the extent permitted by law, the Service is provided without implied guarantees beyond those that cannot lawfully be excluded, and neither party is liable for indirect or consequential loss that was not reasonably foreseeable.
Nothing in these Terms excludes, restricts, or modifies a right or remedy that cannot be excluded under the Australian Consumer Law or another applicable law.
10. Apple terms
If you download OldMate through Apple's App Store, Apple's standard Licensed Application End User License Agreement applies unless OldMate publishes a valid custom EULA in App Store Connect. Apple is not responsible for providing support for OldMate. Any mandatory rights you have under Apple's terms or applicable law continue to apply.
